MEMPHIS, Tenn. — A man is facing murder charges in the deadly shooting of a teen boy early November at a Sonic Drive-In on Kirby Parkway.
Timothy Moore, 55, has been charged with first-degree murder, criminal attempted first-degree murder, employing a firearm with the intent to commit a felony, and being a convicted felon in possession of a handgun.
The Memphis Police Department (MPD) responded to the shooting Nov. 3 just after 5 p.m. at 4130 Kirby Parkway. A 17-year-old had been shot in the chest and taken to Regional One Health in critical condition. He was later pronounced dead.
MPD initially said one man was detained, but then the day following the shooting they stated that two known men had been detained.
According to an affidavit, a witness told police the passenger of a red SUV had stepped out of the car and shot the teen. Investigators found camera footage showing the vehicle leaving the scene.
After finding the SUV's owner during the investigation, the owner said he drove the passenger, Moore, to the restaurant to confront someone who had broken into a car belonging to Moore's wife, the affidavit stated. When they arrived, Moore approached some men and unexpectedly pulled out a gun, firing two shots, the owner said according to the affidavit.
Investigators corroborated the owner's statement by verifying a report to police filed by Moore's wife regarding a theft from her vehicle earlier that day. A short time before the shooting, someone else also called police, telling officers that a suspicious person who the caller believed had burglarized the wife's vehicle was at the Sonic, the affidavit said.
Investigators found that Moore was convicted of criminal attempt first-degree murder and especially aggravated robbery in 2004 and sentenced to 18 years confinement.
Moore is expected to appear in court Monday, Dec. 18.
