Charges dismissed for suspect arrested after Frayser gas station shooting & police chase, according to court records

Memphis police said one officer fired at an armed suspect during a foot chase Aug. 12, 2024.

MEMPHIS, Tenn — Charges have been dismissed for one suspect arrested following a shooting at a Frayser gas station that led to a police chase, which ended with the officer firing a shot at a suspect. Three others are still on the run.

Court records show charges were dismissed Sept. 5, 2024, for the 22-year-old man, due to "Lack of Prosecution."

The Shelby County District Attorney General's Office told ABC24: "The court dismissed this case due to a lack of prosecution, as key witnesses who were subpoenaed did not appear. Our office intends to present the case to the grand jury, seeking an indictment. As a reminder, a dismissal in General Sessions does not prevent our office from continuing the investigation and pursuing an indictment through the grand jury."

Warrants have been issued for two other suspects in the case.

MPD investigators said it all started when an officer heard shots being fired around 4:45 p.m. Monday, Aug. 12, 2024, at the EZ Shop gas station in the 2300 block of Frayser Blvd. Investigators said a man was confronted by four suspects in the parking lot who told him they would shoot him if he moved. Police said the suspects grabbed a gun from the victim's waistband, and the victim and suspects struggled.

Police said at that point, a security guard told them to leave, and one of the suspects pointed a gun at the guard as they took off in a white Ford sedan while firing shots at the guard and victim. MPD said one of the two were hurt but refused to go to the hospital.

Investigators said the officer who heard the shots saw the white sedan speeding away and tried to make a traffic stop. MPD said the car stopped in the 4000 block of Mountain Terrace, and two suspects jumped out and ran, while two other suspects in the car drove away.

MPD said an officer began chasing the two suspects who jumped out of the car, one of whom police said was armed. Investigators said the officer told them to stop but they refused, and the officer fired one shot at one of the suspects for "circumstances still under investigation." They said that suspect continued to run and was not found. Police don't know if he was hit by gunfire.

MPD said officers found the second suspect who ran. They said he had minor injuries and was taken to Regional One Hospital in non-critical condition. MPD later identified that suspect as the man who has since had charges dismissed.

Memphis Police said two officers were injured in the chase, but not from gunfire. They received injuries related to the foot pursuit of the suspects. One officer was taken to the hospital in non-critical condition, while the other was taken to the hospital for treatment, police said.

According to MPD, they found a gun in the area.
