MEMPHIS, Tenn. — A suspect is dead, and another suspect is facing charges after both were shot while trying to burglarize an apartment early Wednesday morning in Raleigh, court records say.
Fernando Diveney, 29, has been charged with first-degree murder during the perpetration of aggravated burglary, and aggravated burglary.
The Memphis Police Department responded to the shooting Feb. 14 around 3:15 a.m. in the 4400 block of Cedar Glenn Drive, where officers found two men suffering from apparent gunshot wounds.
One was pronounced dead on the scene, and the other was taken to Regional One Health in critical condition.
Memphis Police said preliminary information indicated this was an aggravated burglary, and the two people shot were suspects breaking into a residence.
According to an affidavit, the resident shot one of the suspects, who had been walking toward him after gaining access through a bedroom window. The resident then ran out the front door and fired more shots after he saw them again and thought they were planning to harm him.
Diveney told investigators that he and the other suspect, the one who died, have been burglarizing apartments and were told about a TV and some Nike shoes being inside the apartment on Cedar Glenn Drive, where they were shot.
Diveney was later charged and placed in jail.
