Charges dismissed against man accused of shooting at witness, according to court records

Charges have been dismissed against a man accused of shooting at a witness, according to Shelby County court records.

The suspect had been charged with attempted first-degree murder, attempted retaliation for past actions, and possession of a firearm during the commission of a felony with a $1,000,000 bond. According to court records, charges were dismissed on May 31, 2024, due to "lack of prosecution."

In similar cases, the Shelby County D.A.'s Office has said that charges can still be brought before a grand jury for indictment, if they choose.

Memphis Police responded to an aggravated assault on May 2 in the area of James Road and Raleigh-Millington Road, according to an affidavit. Officers said they spoke to a man who told them his sister's boyfriend followed him from court and shot at him from a vehicle. The man told police that he testified at 201 Poplar for a shooting that took place in January where he was shot by the same man multiple times following an argument.

This victim told police that after he was done testifying, he had to drop off his mother and as he drove out of the apartment complex he recognized the vehicle that belonged to the suspect, according to the affidavit. 

He called 911 at that point and shared the situation before he tried to lose the suspect, according to the affidavit. The victim was unfamiliar with many street names in the area he was in, but the suspect caught up to him in the area of James Road and Raleigh Millington Road, according to the affidavit. 

The affidavit said police were told that the suspect pointed a handgun at the victim before firing. The victim said it sounded like a machine gun, according to the affidavit. 

The victim's vehicle was struck and the suspect drove away continuing on James Road, and the victim was able to find the Austin Peay police precinct and met with officers, according to the affidavit. 

The victim identified the suspect in a photo lineup, according to the affidavit. The suspect had been released on a $10,000 bond for the shooting incident in January.
