Court records show charges have been dismissed against a suspect whom Memphis Police said had a long criminal history

MEMPHIS, Tenn. — Court records show charges have been dismissed against a Memphis man whom Memphis Police said had a long criminal history and was rearrested in February 2024 on theft and evading arrest charges.

According to court records, the charges in the February case were dismissed "Nolle Prosequi," Charges filed April 27, 2024, against the suspect for aggravated assault on a first responder, evading arrest, and weapons charges were previously dismissed due to "lack of prosecution." 

According to the affidavits for the dismissed charges, on the night of April 27, U.S. Marshals Task Force deputies were attempting to arrest the suspect on a warrant, when he pointed a gun at a deputy and ran. The affidavit said the man forced his way into a nearby apartment, and was taken into custody when he ran from there. A gun was found in a search of the neighboring apartment. 

In cases such as these, the Shelby County District Attorney's Office has said it retains the right to bring the dismissed charges before a grand jury for possible indictment.

Out on bond

The suspect had previously been arrested on theft, evading arrest, and gun charges in February 2024. He was released from jail after posting $35,000 bond on Feb. 27, 2024.

On Feb. 16 officers reportedly responded shortly after 5 p.m. to the Dollar General at 4045 Elvis Presley Boulevard after they had been told about a stolen vehicle. Officers were told the victim was standing in line when she was approached by a man who demanded her car keys.

This suspect, police said, snatched the keys from this victim and drove away in her 2004 Chrysler Crossfire.

On Feb. 24 officers said they saw the same vehicle driving east on Wabash Street shortly after 1 p.m. Two men exited the vehicle and ran away on foot as police were waiting for additional officers to make the scene, they said. 

The driver entered a house armed with multiple weapons and tried to hide in the attic, according to the Memphis Police Department (MPD). 

The suspect "fell through the ceiling onto the carport area of the house," according to an affidavit in Shelby County court documents.

He was taken into custody, according to MPD. Officers said they checked the immediate area and found three different loaded guns. One of these guns was reported stolen out of Southaven, according to MPD. 

Previous history

Memphis Police said back in 2014, the same man had been convicted of aggravated assault, in which he served six years in the Tennessee Department of Corrections (TDOC). He also had gang affiliation, according to MPD. 

In 2021, he had offenses including failure to appear in a felony case, unlawful carrying or possession of a handgun, criminal attempt at robbery, possession of cocaine with intent to manufacture/sell/deliver and more, according to MPD.

In 2020, he had offenses for theft of property that is worth $1,000 or less and especially aggravated robbery, according to MPD.

In 2019, he had offenses for criminal attempt at robbery and aggravated assault, according to MPD.  His bond was listed at $100,000 at that time.

Finally, in 2018, the man had offenses that included failure to appear in a felony case, possession of a controlled substance in marijuana, being a convicted felon in possession of a handgun, unlawful carrying or possession of a weapon, according to MPD.  Police said his bond was at $10,000 at that time.
