MEMPHIS, Tenn. — On Jan. 31 and Feb. 1, TDOT crews shut down eastbound lanes on I-40 E between the Sycamore View Rd. exit and the flyover to make pavement repairs. Two weeks later, the pavement is still stripped.
The unfinished roadwork is causing cars to kick up rocks, which may crack the windshield of the car behind them.
TDOT said the stretch of road needed to be stripped because many potholes popped up after January's winter storm. But two weeks later, TDOT still has not repaved the interstate.
On Feb. 13, we reached out for an update from TDOT, who said they are hoping to fix the pavement in the coming weeks.
If your car windshield is damaged by rocks flying from unrepaired roads, you can file a claim with the state online to get reimbursed for at least some of your expenses. However, you must have proof, such as a picture, showing the damage. You must also include the exact location where the incident occurred and have receipts showing the cost of your repairs.
Additionally, the state must be aware of the dangerous road condition, and there must be evidence that the state could have made repairs prior to your incident and neglected to do so. Regarding the stretch of I-40, TDOT is aware of the road condition, and they have had two weeks to repave I-40 but have yet to do so.
